The practice of family law

In the UAE, Federal Law No. 28 of 2005 (Personal Status Law) and amendments thereof, govern most matters related to marriage, divorce, succession and child custody. Based on Sharia principles and upheld across all the emirates, the law applies to UAE nationals, and to expatriates residing in the UAE unless they choose their own country’s law.
In certain circumstances, the UAE courts also have the power to hear actions against foreign nationals with no address or place of residence in the country.
Recent amendments have introduced significant changes to the Personal Status Law. For instance, the validity of a marriage and any ensuing divorce and financial elements such as the division of assets and alimony, will now be governed by the law of the country in which the marriage took place. When an expatriate passes away in the UAE, the laws of his country of nationality will now apply when dividing assets among the next of kin. However, if a will is in place, division of assets will be subject to that will, excluding property in the UAE
which is still governed by local law.
